www.lambandshadow.com (hereinafter referred to as ‘BOXER GEN UG (haftungsbeschraenkt)’).
§ 1 Scope
These General Terms and Conditions apply to all claims arising from contracts concluded between BOXER GEN UG (limited liability) and the customer (hereinafter referred to as ‘the customer’) via the website www.lambandshadow.com in the version valid at the time of the order. The seller offers high-quality boxer shorts in particular via its website. The following terms and conditions and the contract text are written in German and can be downloaded to the customer's computer and printed out. Upon request, they can be obtained in digital or written form by sending an email to kontakt@lambandshadow.com.
§ 2 Conclusion of contract
(1) The customer can select products from the BOXER GEN UG (limited liability) range and collect them in a so-called shopping basket by clicking on the ‘Add to basket’ button. After the intermediate steps ‘View basket’ and ‘Checkout’ (or ‘PayPal Checkout’ and registration with PayPal) and the following information on billing details and payment methods (credit and debit cards, GiroPay, Sofortüberweisung (Klarna), PayPal, prepayment), the customer submits a binding request to purchase the selected goods by clicking on the ‘Place order’ button. Before submitting the order, the customer can change and view the data at any time; the customer has the option of correcting input errors before confirming their offer (e.g. by clicking the back button or cancelling the order process and changing the previous entry or by clicking the ‘Edit’ buttons). However, the order can only be submitted and transmitted if the customer has accepted these contractual terms and conditions by clicking on the checkbox ‘The General Terms and Conditions (GTC) apply. I have read the privacy policy. I have read the cancellation policy.’ and thereby included them in their order.
(2) BOXER GEN UG (limited liability) will then send the customer an automatic confirmation of receipt (in the case of payment in advance, the advance payment invoice) by email, in which the customer's order is listed again and which the customer can print out using the ‘Print’ function. The automatic confirmation of receipt merely documents that the customer's order has been received by BOXER GEN UG (limited liability) and does not constitute acceptance of the application. The contract is only concluded upon receipt of payment by BOXER GEN UG (limited liability). In this confirmation of receipt or in a separate email, but no later than upon delivery of the goods, the contract text (consisting of the order, General Terms and Conditions and order confirmation) will be sent to the customer by BOXER GEN UG (limited liability) on a permanent data carrier (email or paper printout) (contract confirmation). The contract text is stored in compliance with data protection regulations and can be requested in digital or written form at kontakt@lambandshadow.com. The customer will be informed by email about the dispatch of the ordered goods as soon as the goods have been handed over by BOXER GEN UG (limited liability) to the transport company.
(3) The contract is concluded in German.
§ 3 Services, prices
(1) BOXER GEN UG (limited liability) endeavours to provide images of the items offered that are as true to the original as possible. However, slight colour deviations are possible.
(2) The total price of the goods, including all associated price components, as well as the payment options and information, are provided in the item description. All prices are final prices plus shipping costs and include statutory value added tax at the applicable rate. The corresponding shipping costs are specified to the customer in the order form and are to be borne by the customer, unless the customer exercises their right of withdrawal.
(3) The payment options are specified in the respective offer. The customer has the following payment options: credit/debit card, Giropay, instant transfer (Klarna), prepayment (bank transfer) and PayPal. If you select the prepayment/bank transfer payment method, BOXER GEN UG (limited liability) will provide you with the bank details in the order confirmation.
§ 4 Delivery, availability of goods; retention of title
(1) The shipping costs are specified in the respective offer under ‘Shipping’. Shipping takes place within 3 working days after receipt of payment, unless a different delivery time is specified for the item. Company holidays are excluded. Shipping is by post or parcel service, unless otherwise agreed. BOXER GEN UG (limited liability) bears the shipping risk if the customer is a consumer.
(2) Until full payment has been made, the delivered goods remain the property of BOXER GEN UG (limited liability).
(3) The following delivery restrictions apply: BOXER GEN UG (limited liability) only delivers to customers who have their habitual residence (billing address) in the United Kingdom and can provide a delivery address in the United Kingdom.
§ 5 Right of withdrawal for consumer contracts
A contract concluded between BOXER GEN UG (limited liability) and the customer via www.lambshadow.de for the delivery of goods is a distance contract within the meaning of § 312 c paragraph 1 BGB. Customers who are consumers within the meaning of § 13 BGB are entitled by law to a right of withdrawal in accordance with §§ 312g, 355 BGB (consumer revocation in distance selling transactions). A consumer within the meaning of § 13 BGB is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Further information on the customer's right of revocation as a consumer can be found in the separate revocation policy. A cancellation policy in text form will be sent to the customer by email. The customer can use the cancellation form to exercise their right of cancellation. In the event of cancellation, the buyer shall bear the direct costs of the return shipment.
§ 6 Registration in our online shop; processing of your personal data
Customers can order goods or services from the BOXER GEN UG (limited liability) online shop as a guest or as a registered user. As a registered user, customers do not have to enter their personal data each time, but can log into their customer account before or during an order using their email address and the password they chose when registering. Registration alone does not constitute any obligation to purchase the goods offered by BOXER GEN UG (limited liability). For information on data processing, please refer to the data protection information, which customers can access here. When registering, customers choose a personal user name and password.
§ 7 Warranty for material defects, guarantee
(1) BOXER GEN UG (limited liability) is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434ff. BGB (German Civil Code). The warranty obligation towards entrepreneurs for goods delivered by BOXER GEN UG (limited liability) is 12 months.
(2) An additional warranty exists for goods delivered by BOXER GEN UG (limited liability) only if this was expressly stated in the order confirmation for the respective item.
§ 8 Liability
(1) Claims for damages by the customer are excluded. This does not apply to claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by BOXER GEN UG (limited liability), its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.
(2) In the event of a breach of essential contractual obligations, BOXER GEN UG (limited liability) shall only be liable for foreseeable damage typical for this type of contract if this was caused by simple negligence, unless the customer's claims for damages arise from injury to life, limb or health.
(3) The restrictions in paragraphs 1 and 2 also apply in favour of the legal representatives and vicarious agents of BOXER GEN UG (limited liability) if claims are asserted directly against them.
(4) The limitations of liability resulting from paragraphs 1 and 2 shall not apply if BOXER GEN UG (limited liability) has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The same shall apply if BOXER GEN UG (limited liability) and the customer have reached an agreement on the quality of the item. The provisions of the Product Liability Act remain unaffected.
§ 9 Final provisions
(1) Contracts between BOXER GEN UG (limited liability) and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which the customer as a consumer has their habitual residence, remain unaffected.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider's registered office.
(3) Information on online dispute resolution: The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr/main/index.cfm. BOXER GEN UG (limited liability) is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
(4) BOXER GEN UG (limited liability) is registered in the packaging register under the number DE1886141255384.
(5) Even if individual points of the contract are legally invalid, the remaining parts of the contract remain binding. The invalid points shall be replaced by the statutory provisions, if any. However, if this would constitute an unreasonable hardship for one of the contracting parties, the contract shall become invalid in its entirety.
